These Terms & Conditions ("Terms") govern your use of getshademe.com and any related pages, tools and content (together, "ShadeMe" or the "Service"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
ShadeMe is a free, independent research tool. It estimates how much sun and shade a given seating area at a stadium, ballpark or arena is likely to receive, for a given date and start time, using a three-dimensional model of the seating bowl combined with calculated solar position and, where available, third-party weather data. No account is required and there is nothing to buy from us.
ShadeMe's output is a modeled prediction, not a measurement or a promise. Real conditions depend on cloud cover, haze, precipitation, retractable roofs and their operation, temporary structures, stage builds, tarps, video boards, renovations, seat relocations, schedule changes, delays and rain delays, and the accuracy of third-party weather forecasts. Venue geometry changes over time and our data may be out of date. You should treat every result as a starting point and confirm the specific seat on the seller's own seating map before you buy. Do not rely on ShadeMe for any decision where sun exposure could affect health or safety; bring sun protection regardless of what the tool says.
ShadeMe contains affiliate links to third-party ticket marketplaces. If you click one and complete a purchase, we may earn a commission at no additional cost to you. See our Privacy Policy & Affiliate Disclosure for the current list of programs. We do not sell tickets and we are not a party to any ticket transaction. All purchases are made with the third-party seller under that seller's own terms, pricing, fees, delivery and refund policies. Any dispute about an order — price, fees, delivery, entry denial, cancellation or refund — is between you and that seller. Our shade rankings are produced by the sun/shade model and are not influenced by commission rates.
You may use ShadeMe for your own personal, non-commercial purposes. You agree not to: scrape, crawl or bulk download the Service except as permitted by our robots.txt; resell, republish or redistribute our shade data as your own product; attempt to interfere with, overload or gain unauthorized access to the Service; or use the Service in violation of any applicable law.
The ShadeMe name, the site design, the underlying shade model and the compiled venue datasets are owned by ShadeMe and protected by applicable law. You may link to any ShadeMe page freely, and you may quote a short excerpt with attribution and a link. You may not copy substantial portions of the site or our datasets without written permission.
Team, league, school, venue and tournament names and marks are the property of their respective owners and are used here descriptively, for the sole purpose of identifying the venue being described (nominative fair use). ShadeMe is an independent tool and is not affiliated with, endorsed by, or sponsored by Major League Baseball, the National Football League, the NCAA, the ATP, WTA or USTA, or any club, school, venue, tournament or ticket marketplace.
The Service links to and relies on third parties, including weather data providers, ticket marketplaces, analytics and advertising networks. We do not control those services, are not responsible for their content, availability, pricing or practices, and their terms and privacy policies apply when you use them.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SHADE ESTIMATE WILL BE CORRECT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHADEME AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, TICKET COST, TRAVEL COST, OR ENJOYMENT, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR ANY RELIANCE ON A SHADE ESTIMATE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold harmless ShadeMe and its operator from any claim arising out of your misuse of the Service or your violation of these Terms or of any law or third-party right.
We may change, suspend or discontinue any part of the Service at any time, and we may update these Terms. The "Last updated" date above reflects the current version. Continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute not otherwise resolved.
